Parenting and Decision-Making

Family law, parenting, and decision-making are complex matters. These are especially challenging and emotionally demanding since children are involved. At De Krupe Law, we stand by your side through every stage of your separation, prioritizing the well-being and best interests of your children.

The Essense of Parenting and Decision-Making

The term “decision-making responsibility” was previously known as “custody”. It refers to the legal right to make important decisions about a child’s life, including but not limited to education, healthcare, and religion. There are two types of decision-making responsibilities:

  • Sole decision-making responsibility, when only one parent has the exclusive right to make these decisions;
  • Joint decision-making responsibility, which allows both parents to share the responsibility of decision making.

Parenting, before referred to a “access,” is about settling on the time that a child spends with each parent. The child needs to have a significant and meaningful relationship with both parents, unless exceptional circumstances call for an alternative approach. In some situations, sole parenting can be granted to just one parent.
